Ivan Nechiprook: “Having served for almost 10 years, I didn’t believe that I would be free” two years ago the guy won the European Court of Human Rights, but only now the human rights activists and journalists fought for almost ten years for the liberation of the resident of Khmelnitsky, Khmelnitsky in the photo. However, Khmelnitsky Gorraisud considered that there was no evidence of Ivan’s guilt in the case, and justified the guy. Nechiporuk was not recognized by a single witness, and not a single examination confirmed his guilt. It would seem that the story should end there. But the police, whose accusation of the court was smashed to smithereens, were not going to give up.

After a year and a half, Ivan was behind bars again. But even after that he did not go free. Before the detention, Ivan, who was 22 years old at that time, knew the woman only clearly. However, Nechiprookruk did not immediately become a suspect. At first, different versions of the murder were built: business disassembly, competitors' revenge and simply robbery. It was also rumored that her son Gennady, the name changed, the only witness of the crime that was next to the mother could be involved in the death of a woman.

Gennady himself told the police that on the day when he left the apartment early in the morning, he was attacked by two unknown masks. The mother who ran out to the noise began to protect him. Then the criminals fired at her several times and disappeared. The noise in the corridor was heard by the neighbors. But they saw the attackers only from the back - according to them, they were "young people, most likely students, thin, tall - centimeters." Soon in local newspapers, police officers posted the signs of suspects.

And then I was among the suspects. Gena and I saw each other several times at work with my wife Natasha worked with Nina Egorova fashion designer. A few days after the murder of Egorova, I met on the street of my friend Sasha Motzny. He offered me to give me a lifting, and we started a murder about this murder. I began to resist and received several shots on the back of the head. Then, between my legs and through the handcuffs, they stuck scrap, fixed it on two tables and hung me with their backs down. The dents on the tables immediately struck - obviously, I was not the first to arrange such an execution. Police officers attached the bare wires of a field phone to my feet.

I felt an electric discharge through my body. Then I was still silent, and they beat me. On the back, on the ribs, in the face. At some point, it seemed to seem that there were no teeth left in the mouth. Then they connected the phone again. And not only to the legs - they beat the current throughout the body. From time to time I lost consciousness - I was doused with cold water and continued torture.

And when I was hit on the wall on the wall, the feeling appeared that the internal organs stuck to the spine. Torture continued all night and morning. Then physical torture was replaced by moral. Natasha was in the eighth month of pregnancy. Soon I saw her brought to the district department.

From the cabinet where my wife was brought, I came a female scream, my hysteria began. I shouted that it was to blame for all the murders in the world, including Listyev and Gongadze. But as for Gongadze - everything could be a pregnant woman who was kept in the district department until the evening and, having not achieved anything from her, let go. About the same thing happened with the second arrested Alexander Motskn.

He was forced to undress naked and photographed in obscene poses - they threatened that they would show these pictures in the zone. Only this decision saved ”the fact that the law enforcement officers never found objective evidence of the fault of Ivan Nechiporuk and Alexander Motzny, it became clear when the Khmelnitsky Gorraisud began to listen. So, all the witnesses, among whom was the son of the murdered, claimed that criminals of medium height were centimeters.

The growth of Nechiporuk is centimeters. At the site of the murder of Egorova, blood was discovered, who did not belong to either her or her son. However, the DNA expertise investigator of the police question why, the investigator at first said that the blood was enough only to determine the group, and then even stated that the blood, judging by the materials of the case, Ivan and Alexander, identified only one witness-a taxi driver who brought two young people to the entrance of Nina Egorova.

But in court, the taxi driver abandoned these testimonies, saying that he sees Nechiporuk and Motzny for the first time in his life.According to the man, the employees of the southwestern regional department detained him and also threw the drugs, after which they threatened that if they did not recognize “who should,” he himself will become a suspect. All charges were removed from Ivan Nechiporuk and Alexander Motzny.

The son of the deceased filed an appeal. Khmelnitsky Court of Appeal satisfied his complaint and sent the case for a second consideration. The Shepetovsky court, where the case was transferred, also sent him for a subsequence. The next court was already in Ternopol. There were no new evidence in the case. The motivating parts of the sentences of the Khmelnitsky Gorraion Court and the Ternopil City Court are actually identical.

Only conclusions are distinguished: instead of justification - 15 years in prison! The verdict of the Ternopil court, in fact, was based on the fact that Nechiporuk and Motzny admitted the murder. Say, they wrote a confession - that means they are to blame. The appeal and the Supreme Courts upheld the decision in force. Famous Ukrainian human rights defenders stood up for me. There was not a single evidence of my guilt in the case, but I could not achieve anything.

We wrote dozens of complaints to all kinds of authorities - there were no answers. I already completely lost hope when I suddenly received a letter from the European Court of Human Rights. Having carefully studied the materials of the case to my complaint, I attached the conclusion of a forensic examination, confirming that I had numerous beatings and burns on my body, the European Court Commission admitted that I wrote a confession under torture.

This decision, in the end, saved me. The European Court decided to pay 35 thousand euros of moral compensation and 13 thousand euros of compensation for legal expenses to the convicted person and his wife. We wanted a letter from Strasbourg to be commented by one of the employees of the Southwestern regional police department who tried Ivan. But it turned out that immediately after the Khmelnitsky Gorraisud handed to Ivan an acquittal, almost all police officers from the southwestern regional department either quit or transferred to other units.

The head of the regional department, for example, went to work on the dispatch remote control "". As for the initiator of all the torture - the then head of the criminal investigation, he even received a promotion - now he occupies one of the leadership posts in the Central district police department. For several days in a row, we tried to get through to him, but the officer did not call to the phone.

Now I try not to part with her at all ”Despite the decision of the European Court, Ivan Nechiporuk was still behind bars. However, he perked up and continued the struggle. And the board of the judges of the Supreme Court, composed of 40 people, decided to send Nechiporuk the case for a new consideration. Khmelnitsky Gorraiynaya Court again began to conduct a judicial investigation.

The neighbors noticed two guys who at about the time when they killed Egorov, left the entrance, but they looked completely different and growth were lower. Moreover, the son of the deceased Gennady initially gave the same testimony! The court asked him to explain this inconsistency. But, passing along the avenue, I saw Nechiporuk and Motzny and the fact that they were killers, the sixth feeling prompted me.

” On the basis of his “sixth feeling”, police officers built the charge. By the way, judging by the fact that the witnesses reported, Gennady’s behavior was very strange. Naturally, the neighbors did not listen to him.
